Project overview
The purpose of this project was to protect members of the public from substantial risk of harm from individuals whose release into the community would pose that risk. The project considers: relevant provisions in the Mental Health (Compulsory Assessment and Treatment) Act 1992 and the Criminal Justice Act 1985, including the definition of mental disorder in the 1992 Act; and whether the Criminal Justice Act 1985 or any other enactment should be amended to confer a power to continue to detain a person beyond the time the person is, under the present law, entitled to be released.

Government response
Some of the Commission’s recommendations were included in the Criminal Procedure (Mentally Impaired Persons) Act 2003.
There was no requirement for the Government to present a formal response to Commission reports before April 2009.
